Terms of Service

The service

Flexfolio is a portfolio builder with an integrated blog and newsletter. We may add, change, or remove features over time. We aim to keep the service available and reliable, but we provide it on an "as is" and "as available" basis.

Your account

You are responsible for your account, for keeping your login secure, and for everything that happens under it. You must provide accurate information and be at least 16 years old. Tell us promptly if you suspect unauthorised use.

Your content

You own the content you add to Flexfolio. You grant us a limited licence to host, store, display, and deliver that content so we can run the service, including publishing your portfolio and sending the emails you choose to send. You are responsible for your content and for having the rights to use it.

Acceptable use

You agree not to use Flexfolio to:

• Break the law or infringe someone else's rights.
• Send spam, or email people who have not agreed to hear from you.
• Publish content that is unlawful, deceptive, harmful, or hateful.
• Attempt to disrupt, abuse, or gain unauthorised access to the service.

You are solely responsible for complying with anti-spam and privacy laws when you contact your subscribers.

Plans, billing, and trials

Flexfolio offers a free plan and a paid Pro plan. Current pricing is shown on our pricing section. New accounts include a 14-day Pro trial, with no card required to start.

• Paid subscriptions are billed in advance through Stripe on a monthly or annual basis, and renew automatically until cancelled.
• You can cancel any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
• Except where required by law, payments are non-refundable and we do not provide partial refunds for unused time. If you believe you were charged in error, contact us.
• Founding member pricing, where offered, stays at the founding rate for as long as the subscription remains active. We may change standard prices for new subscriptions on a forward-looking basis.

Custom domains

Pro lets you connect a custom domain. You are responsible for owning and maintaining that domain. Certificates and delivery are handled through our infrastructure providers.

Termination

You can stop using Flexfolio and delete your account at any time. We may suspend or terminate accounts that breach these Terms or that create risk or legal exposure. On termination, your right to use the service ends and your public content may be removed.

Disclaimers and liability

To the extent permitted by law, Flexfolio is provided without warranties of any kind, and we are not liable for indirect or consequential loss, or for loss of data, revenue, or profits. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where our liability cannot be excluded but can be limited, it is limited to resupplying the service or paying the cost of resupply.

Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

Changes

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you through the service. Continued use after changes means you accept the updated Terms.
